1. Operator and acceptance

Countyguard is a brand of Eldhurst LLC ("Countyguard," "we," "us," or "our"). These Terms govern your use of countyguard.com. By using the site, you agree to these Terms. By selecting a telephone link, you request the connection described below and agree to these Terms. If you do not agree, do not use the site or select a telephone link.

2. General informational service

The site provides general educational information compiled from public sources. It is not individualized advice and is not a substitute for an inspection, your insurance policy, government instructions, or advice from a qualified professional.

Countyguard is not a restoration contractor, insurer, insurance agent, public insurance adjuster, law firm, engineering firm, medical provider, environmental consultant, emergency service, or government agency.

3. Emergencies and safety

If anyone may be in danger, leave the area and call 911 or the appropriate utility. Do not enter moving or contaminated water, touch wet electrical equipment, enter an unsafe structure, or perform a task you cannot perform safely. Conditions vary, and online information cannot evaluate your property.

4. No professional or representative relationship

Your use of the site does not create an attorney-client, insurer-insured, adjuster-client, contractor-customer, fiduciary, agency, employment, joint-venture, or other professional relationship with Countyguard.

Countyguard does not represent you, interpret your insurance policy, prepare or file a claim, negotiate or adjust a claim, advise what an insurer owes, or communicate with an insurer for you. This material is not a substitute for advice from a licensed attorney.

5. Paid provider connections

Telephone numbers on the site may connect you through an independent call-routing network to an independent service provider. Countyguard is paid if a call results in a qualified connection under its network agreement. Countyguard does not charge you a connection fee, and you have no obligation to hire a provider.

6. Independent providers

Service providers are independent businesses, not Countyguard employees or agents. Countyguard is not a party to any estimate, authorization, contract, warranty, payment, insurance claim, dispute, or other relationship between you and a provider.

Unless expressly disclosed for a specific provider, Countyguard does not represent that it has verified the provider's identity, location, availability, license, registration, insurance, bonding, training, background, price, quality, or suitability. Before authorizing work, obtain the provider's legal business name and independently verify all requirements relevant to the work.

7. Insurance and contract decisions

Insurance coverage depends on the policy, endorsements, exclusions, facts, and applicable law. General examples on the site do not determine whether your loss is covered. Promptly contact the appropriate insurer or agent and consult a Texas-licensed public insurance adjuster or attorney when you need advice about a claim.

Read any contractor authorization before signing. Countyguard does not review assignments of benefits, powers of attorney, directions to pay, financing, cancellation terms, scopes, prices, or other contracts for you.

8. Data and corrections

Countyguard uses public government datasets and documents its methods and source dates. Public records may contain errors, omissions, revisions, suppression, reporting delays, or geographic inconsistencies. Historical statistics do not predict whether a future event or loss will occur and do not describe a particular property.

9. Third-party sites and services

The site links to government agencies and other third parties. Third parties control their own content, availability, privacy practices, and services. A link does not constitute endorsement unless the site expressly says otherwise.

10. Intellectual property

The site design, original text, organization, graphics, software, and Countyguard branding are owned by Eldhurst LLC or used with permission and are protected by applicable intellectual-property laws. Government records remain subject to their source terms and applicable law.

You may use the site for personal, noncommercial informational purposes. You may not remove notices, impersonate Countyguard, interfere with the site, introduce malicious code, or use automated means that materially burden the service.

11. No warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND CONNECTION SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." COUNTYGUARD DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, AND RESULTS. COUNTYGUARD DOES NOT WARRANT THAT A PROVIDER WILL BE AVAILABLE OR THAT ANY PROVIDER'S WORK, PRICE, RESPONSE, OR CONDUCT WILL MEET YOUR NEEDS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELDHURST LLC AND ITS MEMBERS, MANAGERS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, OR LOSS ARISING FROM A THIRD-PARTY PROVIDER OR CONTRACT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR AGGREGATE LIABILITY ARISING FROM THE SITE OR CONNECTION SERVICE WILL NOT EXCEED $100.

These limitations do not exclude liability that cannot lawfully be excluded, and they do not limit rights or remedies that applicable consumer law makes nonwaivable.

13. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Eldhurst LLC and its members, managers, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of the site, your violation of these Terms, or your dealings with any independent provider. This obligation does not apply where it is prohibited by applicable consumer-protection law, and it does not limit rights or remedies that applicable law makes nonwaivable.

14. Governing law and disputes

These Terms are governed by Massachusetts law, without regard to conflict-of-law principles, except that this choice does not deprive you of mandatory protections of the law that otherwise applies to you. A proceeding concerning these Terms may be brought in a court with lawful jurisdiction in Massachusetts or any other venue required or permitted by applicable law.

15. Changes

We may update these Terms prospectively by posting a revised version and effective date. Material changes will receive additional notice when required by law. Changes do not retroactively alter an accrued claim unless applicable law permits it.

16. Severability and no waiver

If a provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver.
